It is worth remembering that CCTV footage may not be retained indefinitely, so acting promptly can be important.

How Does a Child Injury Claim Work?

When a child is under 18, they generally cannot conduct civil proceedings independently in the same way as an adult. A suitable adult may therefore act as a litigation friend on the child’s behalf. The Civil Procedure Rules provide for children involved in proceedings to have a litigation friend unless the court permits them to conduct proceedings themselves.

A parent or another suitable adult may take on this role, subject to the relevant requirements. The litigation friend is expected to act in the child’s best interests rather than simply pursuing what is most convenient for the adults involved.

This is one reason why seeking advice from a solicitor experienced in cases involving children can be valuable. The legal process can involve medical evidence, questions of liability, future needs and, where appropriate, court approval of a settlement.

What Compensation Could Cover

Compensation is not simply about the immediate physical injury.

Depending on the circumstances, a settlement may take account of the child’s pain and suffering, psychological consequences and the impact the injury has had on their everyday life.

There may also be financial losses and expenses associated with the injury. These could potentially include travel costs, treatment expenses, rehabilitation, specialist equipment, educational support and additional care, depending on the individual circumstances.

For a serious injury, it may be necessary to consider how the condition could affect the child’s education, independence, employment prospects and care requirements in the future.

This is particularly important because some childhood injuries have consequences that cannot be fully understood immediately after an accident. Medical evidence and expert assessments may therefore be required before the full value of a claim can be established.

How Long Do Parents Have to Make a Claim?

Time limits for personal injury cases can be complicated, particularly where the injured person is a child.

In England and Wales, a child will generally have until their 18th birthday to bring a personal injury claim through a litigation friend. If proceedings have not been started while the person is a child, the usual position is that the three-year limitation period begins when they reach adulthood, although there are important exceptions and individual circumstances can affect limitation.

This means parents should not assume that there is no urgency simply because the injured person is under 18.

One of the biggest challenges after an accident is establishing exactly what happened.

For example, photographs can show the condition of an accident location. Witnesses may be able to explain what they saw. Medical records can establish the nature and extent of the injuries, while CCTV may provide direct evidence of the incident.

Parents can also keep a simple diary documenting the child’s recovery. Recording changes in mobility, sleep, behaviour, school attendance, hobbies and everyday activities may help demonstrate the wider impact of an injury.

What Happens to Compensation Awarded to a Child?

Compensation awarded to a child is treated differently from an ordinary adult personal injury settlement.

Where a settlement is reached before the child turns 18, court involvement may be required. In England and Wales, settlements involving children can require approval by the court to ensure that the proposed outcome is in the child’s best interests.

Where money is awarded to a child, arrangements may also be made for the funds to be protected until the child reaches adulthood. The Court Funds Office explains that it can hold compensation paid to a child until they turn 18.

These safeguards exist because the compensation belongs to the child rather than the parent or litigation friend.

Should Parents Seek Legal Advice?

A child’s injury can be distressing for the whole family, particularly when another person’s actions may have contributed to what happened.

Parents should not feel pressured into making assumptions about whether they have a valid claim or how much compensation an injury may be worth. A child injury claim specialist solicitor can assess the circumstances, identify the relevant evidence and explain the available options.

This can be particularly important where an injury is serious, liability is disputed or there may be long-term consequences.

The most appropriate approach is to concentrate first on the child’s recovery while making sure potentially important evidence is preserved.
