What Parents Should Know After a Child Is Injured Because of Someone Else’s Negligence

When a child is injured in an accident, the immediate priority is always their health and wellbeing. However, if the injury was caused by another person’s negligence, parents and guardians may also need to consider whether compensation could help with the consequences of the accident. Understanding how child injury claims work can help families make informed decisions while protecting a child’s interests.

Children can be injured in many different circumstances, including road traffic accidents, school incidents, playground accidents, defective equipment, accidents in public places and certain cases of medical negligence. Each situation is different, and whether compensation may be available will depend on the circumstances and evidence surrounding the injury.

When Could a Child Be Entitled to Compensation?

A personal injury claim generally requires evidence that another party owed the child a duty of care, breached that duty and caused an injury as a result.

For example, a school may have responsibilities relating to the maintenance of its premises and the supervision of pupils. Similarly, businesses and organisations responsible for public spaces may have obligations to take reasonable steps to keep visitors safe.

Road users also have responsibilities towards other people using the road. If a child is injured because a driver was speeding, distracted or otherwise driving negligently, there may be grounds for a compensation claim.

The fact that an accident occurred does not automatically mean that somebody else is legally responsible. The circumstances need to be carefully examined, which is why obtaining appropriate legal advice can be important.

Common Situations Where Children Are Injured

Children are naturally active and may be exposed to risks at home, school, during leisure activities and while travelling. Some accidents are unavoidable, while others may occur because reasonable safety measures were not taken.

School and Playground Accidents

Schools and educational establishments have responsibilities towards the children in their care. Accidents may involve poorly maintained playground equipment, inadequate supervision, unsafe premises or failures relating to appropriate risk assessments.

A child could, for example, suffer a fracture after falling from defective playground equipment or sustain an injury during a school activity where appropriate precautions were not taken.

Evidence can be particularly important in these cases. Accident book entries, photographs, witness details, school records and medical evidence may all help establish what happened.

Road Traffic Accidents

Children can be particularly vulnerable as pedestrians, cyclists and passengers.

A collision involving a vehicle can result in anything from relatively minor injuries to serious brain or spinal injuries. Where another road user’s negligence caused the accident, the circumstances may justify pursuing compensation.

Parents should keep records of medical appointments and treatment following an accident. Photographs of visible injuries and details of witnesses may also prove useful.

Accidents in Public Places

Children can also be injured in parks, shopping centres, leisure facilities, restaurants and other public areas.

Potential hazards might include defective flooring, poorly maintained play equipment, unmarked hazards or other dangerous conditions.

However, not every accident in a public place will result in a successful claim. It is necessary to establish whether the organisation or individual responsible for the area failed to meet the required standard of care.

What Should Parents Do After an Accident?

The steps taken immediately after an accident can make a significant difference to both the child’s recovery and any subsequent legal case.

First, make sure the child receives appropriate medical attention. Even when an injury initially appears minor, symptoms can sometimes develop or become more apparent later.

Next, report the accident where appropriate. For example, an incident at school may need to be recorded with the school, while an accident in a shop or leisure facility may need to be reported to the management.

Parents should also preserve evidence wherever possible.

Useful evidence may include:

  • Photographs of the accident location
  • Photographs of visible injuries
  • Names and contact details of witnesses
  • Medical records and hospital documentation
  • Accident report forms
  • CCTV or dashcam footage
  • Receipts for injury-related expenses
  • Records showing missed school or activities
  • Notes describing how the injury affects the child’s everyday life

It is worth remembering that CCTV footage may not be retained indefinitely, so acting promptly can be important.

How Does a Child Injury Claim Work?

When a child is under 18, they generally cannot conduct civil proceedings independently in the same way as an adult. A suitable adult may therefore act as a litigation friend on the child’s behalf. The Civil Procedure Rules provide for children involved in proceedings to have a litigation friend unless the court permits them to conduct proceedings themselves.

A parent or another suitable adult may take on this role, subject to the relevant requirements. The litigation friend is expected to act in the child’s best interests rather than simply pursuing what is most convenient for the adults involved.

This is one reason why seeking advice from a solicitor experienced in cases involving children can be valuable. The legal process can involve medical evidence, questions of liability, future needs and, where appropriate, court approval of a settlement.

What Compensation Could Cover

Compensation is not simply about the immediate physical injury.

Depending on the circumstances, a settlement may take account of the child’s pain and suffering, psychological consequences and the impact the injury has had on their everyday life.

There may also be financial losses and expenses associated with the injury. These could potentially include travel costs, treatment expenses, rehabilitation, specialist equipment, educational support and additional care, depending on the individual circumstances.

For a serious injury, it may be necessary to consider how the condition could affect the child’s education, independence, employment prospects and care requirements in the future.

This is particularly important because some childhood injuries have consequences that cannot be fully understood immediately after an accident. Medical evidence and expert assessments may therefore be required before the full value of a claim can be established.

How Long Do Parents Have to Make a Claim?

Time limits for personal injury cases can be complicated, particularly where the injured person is a child.

In England and Wales, a child will generally have until their 18th birthday to bring a personal injury claim through a litigation friend. If proceedings have not been started while the person is a child, the usual position is that the three-year limitation period begins when they reach adulthood, although there are important exceptions and individual circumstances can affect limitation.

This means parents should not assume that there is no urgency simply because the injured person is under 18.

Obtaining advice early can help preserve evidence, identify potential defendants and ensure that important procedural requirements are understood.

Why Evidence Matters

One of the biggest challenges after an accident is establishing exactly what happened.

A child’s account may be important, but depending on their age and circumstances, they may not be able to provide all the information needed to establish liability.

Other evidence can therefore become particularly valuable.

For example, photographs can show the condition of an accident location. Witnesses may be able to explain what they saw. Medical records can establish the nature and extent of the injuries, while CCTV may provide direct evidence of the incident.

Parents can also keep a simple diary documenting the child’s recovery. Recording changes in mobility, sleep, behaviour, school attendance, hobbies and everyday activities may help demonstrate the wider impact of an injury.

What Happens to Compensation Awarded to a Child?

Compensation awarded to a child is treated differently from an ordinary adult personal injury settlement.

Where a settlement is reached before the child turns 18, court involvement may be required. In England and Wales, settlements involving children can require approval by the court to ensure that the proposed outcome is in the child’s best interests.

Where money is awarded to a child, arrangements may also be made for the funds to be protected until the child reaches adulthood. The Court Funds Office explains that it can hold compensation paid to a child until they turn 18.

These safeguards exist because the compensation belongs to the child rather than the parent or litigation friend.

Should Parents Seek Legal Advice?

A child’s injury can be distressing for the whole family, particularly when another person’s actions may have contributed to what happened.

Parents should not feel pressured into making assumptions about whether they have a valid claim or how much compensation an injury may be worth. A child injury claim specialist solicitor can assess the circumstances, identify the relevant evidence and explain the available options.

This can be particularly important where an injury is serious, liability is disputed or there may be long-term consequences.

The most appropriate approach is to concentrate first on the child’s recovery while making sure potentially important evidence is preserved.

Final Thoughts

Accidents involving children can have consequences that extend far beyond the initial injury. Where negligence may have played a role, understanding the legal options can help parents make decisions that protect their child’s interests.

Keeping detailed records, preserving evidence and obtaining specialist advice at an early stage can all help establish what happened and whether compensation may be appropriate.

Most importantly, every case is different. The circumstances of the accident, the evidence available, the severity of the injury and its potential long-term effects all need to be considered before deciding how to proceed.
