UK Tax Planning for Expats: 7 Costly Mistakes to Avoid in 2026 Guide

Moving to the UK, leaving it, or splitting your time between countries creates tax questions that few people anticipate. Residency status, foreign income, and property ownership all interact, and one wrong assumption can trigger penalties, double taxation, or an unexpected inheritance tax bill. Advisory sources such as Spice Taxation regularly highlight that most expat tax problems come from avoidable planning gaps rather than complex loopholes.

The rules changed significantly in April 2025, when the UK replaced the old domicile and remittance basis system with a residence-based approach. By 2026, those changes shape almost every expat decision. This guide explains seven mistakes that cost expats the most money and shows you how to avoid each one.

Seven Costly Mistakes Expats Make

1. Misjudging Your UK Tax Residency Status

Many expats count days in the UK and stop there. The Statutory Residence Test goes further. It combines automatic overseas tests, automatic UK tests, and a “sufficient ties” test that weighs your family, accommodation, work, and previous UK presence.

Why Day Counting Alone Fails

You could spend fewer than 183 days in the UK and still be a tax resident if you have a home here, work here, and have strong family links. Keep a detailed travel diary and review your ties before each tax year begins on 6 April.

2. Relying on Outdated Domicile and Remittance Rules

Before April 2025, long-term expats could claim the remittance basis and keep foreign income offshore. That system is gone. Anyone still planning around “non-dom” status is working from an old playbook.

The New Foreign Income and Gains Regime

Under the current system, new arrivals who have not been UK resident in the previous ten tax years can claim a four-year exemption on foreign income and gains. After that, worldwide income becomes taxable in the UK. The comparison below shows what changed:

  • Old remittance basis: Tax applied to foreign income only when you brought it into the UK, and eligibility depended on domicile.
  • Current FIG regime: The exemption applies for the first four years of residence regardless of domicile, and you do not need to track remittances during that window.
  • After the four years: Worldwide income and gains are taxable as they arise, so restructuring before year five matters.

3. Overlooking Inheritance Tax Exposure

Inheritance tax now follows residence rather than domicile. Once you have lived in the UK for ten of the last twenty tax years, your worldwide estate can fall within UK inheritance tax at 40%. Leaving the UK does not end this immediately, because a “tail” of three to ten years applies depending on how long you stayed.

Review wills, trusts, and life insurance arrangements early. Cross-border estates often need coordinated documents in each country.

4. Ignoring Double Taxation Treaties

Expats often pay tax twice on the same income because they never claim treaty relief. The UK has agreements with more than 130 jurisdictions, and each one sets out which country taxes pensions, dividends, employment income, and property gains first.

Claim foreign tax credits on your Self Assessment return, and keep proof of tax paid abroad. Without records, HMRC can reject the claim.

5. Mishandling UK Property and Capital Gains

Non-residents who sell UK property must report the disposal to HMRC within 60 days of completion, even when no tax is due. Missing that deadline leads to automatic penalties that grow over time. Capital gains tax rates on residential property are currently 18% or 24%, depending on your income level.

Landlords living abroad should also register under the Non-Resident Landlord Scheme or arrange for rent to be paid without UK tax deducted. Otherwise, letting agents or tenants may withhold basic rate tax.

6. Leaving the UK Without Planning the Exit

Departing in the wrong tax year or without evidence of non-residence can leave you taxed on income you thought was safe. Split-year treatment may apply when you leave part-way through a tax year, but only if you meet specific conditions.

The Temporary Non-Residence Trap

If you return within five years, certain gains and dividends from your time abroad can become taxable in the UK. Selling a business or share portfolio during a short stint overseas is a common way to fall into this rule.

7. Missing Pension, National Insurance, and Filing Deadlines

Expats frequently forget that UK pensions, overseas pensions, and National Insurance records need separate attention. Voluntary National Insurance contributions can protect your State Pension entitlement, yet the eligibility rules for paying from abroad have tightened from April 2026. Check your record before you assume you can fill gaps later.

Filing deadlines catches people out too. Self Assessment returns are due by 31 January following the tax year, and late filing penalties begin immediately. Overseas pension transfers may also face a charge if they do not meet qualifying conditions.

How to Build a Stronger Expat Tax Plan

Good planning follows a repeatable routine. Start by confirming your residence status every year. Next, map out all income sources and identify which country has first taxing rights. Then review your estate documents, property holdings, and pension arrangements against the current rules rather than the rules you learned five years ago.

A qualified adviser who understands both UK law and your other country of residence adds real value here. Rules shift each Budget, so a yearly review costs far less than a single missed deadline or misjudged exemption.

Final Thoughts: Plan Early, Pay Less, Stay Compliant

UK tax planning for expats rewards those who act before problems appear. Residency tests, the new FIG regime, inheritance tax, treaty relief, property reporting, exit timing, and filing deadlines all carry real financial consequences when ignored. Review each area now, document your decisions, and seek professional guidance tailored to your situation. This article offers general information only and does not replace personalised tax advice.
